LEGAL ASPECTS AND CONDITIONS OF SALE

These conditions and legal terms (hereinafter “General Conditions”) regulate the contracts concluded successively between the Istituto Storico San Josemaría Escrivá, with registered office at Via dei Farnesi 82 00186 Rome, Italy (hereinafter the “Publisher”), and the consumer (hereinafter the “Customer”). The objective of these contracts is the online purchase of the items offered on the studiaetdocumenta.org website (hereinafter “Website”)
MAIN FEATURES OF THE GOODS OR SERVICES

The Website offers an online subscription purchase service for the journal “Studia et Documenta. Rivista dell’Istituto Storico San Josemaría Escrivá” (hereinafter “Studia et Documenta”), in paper or digital format (consultation of the journal directly on one’s own PC or by means of mobile devices and tablets). All subscriptions, whether in paper format or digital format may have a duration of one, two or three years.

PRICES, VAT, SHIPPING COSTS
All the subscription prices of back issues and “Studia et Documenta” special offers are those listed on the web site inclusive of VAT. Shipping costs are calculated based on the weight of the items and their destination.
Items available on the website may be purchased online using the Gestpay payment service provided by Banca Sella S.p.A. or Stripe with VISA, VISA ELECTRON, MASTERCARD and AMERICAN EXPRESS credit cards or by using the PayPal system. The order should be submitted as follows:
• place the desired items in the shopping cart,
• add all the required information relating to shipping and billing,
• fill in the credit card details,
• confirm the purchase.
Once the purchase order has been confirmed, the customer’s name and number are requested. The system now opens a secure and encrypted SSL connection with the Banca Sella or Stripe web or PayPal. When this is done, it is just as if the user had personally entered the bank, with an absolute guarantee of the safeguard of privacy and security. It is only then that the credit card details are requested.
The personal security codes of the credit card are provided exclusively and directly by the Bank, Stripe or PayPal. Once these codes have been verified in real time by the Bank or PayPal then the purchase will be approved immediately.
Moreover, the system, by means of the corresponding “banking key control procedure” always checks that the web where the payment is made is indeed studiaetdocumenta.org, and vice versa, that the response to the transaction carried out is indeed correctly given by Banca Sella, Stripe or PayPal.
OTHER PAYMENT METHODS
Payment may also be made by Bank transfer in favor of ISTITUTO STORICO SAN JOSEMARÍA ESCRIVÁ, always clearly indicating the customer number or full name. The account details are:

Bank charges will be paid by the person making the transfer.
Checks are not accepted and cash should not be sent by mail.
Payment may only be made in EUROS.
SHIPPING AND DELIVERY
Each year there is only one delivery of the journal for the current year in paper format. This delivery usually takes place a few weeks after the publication of the latest issue (generally in April). Delivery time for Italy usually takes a few days. For the rest of the world, it depends on the destination but it usually takes 10-15 days. Individual requests from the webpage will take from 5-10 days to reach their destination. These delivery times are indicative only and not legally binding.
Deliveries are made using courier.
Items in digital format may be downloaded from the web page a few weeks after publication of the journal in paper format. This is done by entering the credentials which were sent to the customer by e-mail when the subscription was purchased. Each item may be downloaded as many as 10 times and may be installed in a maximum of 10 electronic devices.
COMPLAINTS, RIGHT OF WITHDRAWAL
If the item has not been received by the expected delivery date then we recommend that you inform us immediately so that we can contact the transport company to resolve any potential problem. If resolution is not possible or if the item has been lost then a replacement copy will be sent completely free of charge.
If for any reason you are not satisfied with the items received, you can change them or request a refund. There is a 14 days period for the exercise of the right of withdrawal. To do this, simply send a claim to email@example.com and return the product by mail. It is advisable to ship the product by registered mail thus making it possible to trace the package at any time via the website of the mail service used. Shipping costs will be the responsibility of the customer unless you have received defective, damaged or incorrect items. The Publisher will make every effort to replace damaged or defective items. If replacement is not possible, then the Publisher is only required to reimburse the amount paid.
The right of withdrawal does not extend to e-books based on Section 59, subsection 1.o of the Italian Consumer Code. In fact the Law does not contemplate the right of withdrawal for digital items bought or downloaded over the internet.
In order to purchase digital products it is necessary to register on the Website. By purchasing a digital item, the customer is automatically registered as a user and the access credentials will be sent to the customer by e-mail after the purchase has been completed.
If no purchase is made then the Website registration is optional.
The digital edition consists of the following formats: PDF (which can be read with the free Adobe Reader), ePub (for tablets and smartphones with Apple or Android operating systems, etc.) and mobi (for Amazon Kindle devices).
The customer will receive a hyperlink by email by means of which a compressed ZIP file may be downloaded containing the digital formats purchased. Alternatively if the customer has been advised in this regard at the time of purchase, the digital format can be downloaded from the user account on the website after the customer has gained access with the credentials received via e-mail at the time of purchase.
The complete digital content is subject to intellectual property rights (industrial or copyright or connected). These rights belong exclusively to the respective owners.
Customers are reminded that current legislation considers any act of economic use of digital content reserved to the owner of the intellectual property rights to be prohibited to the user without the express consent of the right holder.
The Publisher cannot be held liable for any violation of the sales contract of the items offered online on the website in the case of missing items or item unavailability, force majeure, mechanical failure, an interruption or a total or partial strike in the postal, transport and / or telecommunications services.
All information contained on the website, all trademarks reproduced, all programs and / or technologies provided in relation to the website and, generally, all or part of the web, are reserved and protected. You may not reproduce trademarks and logos in use on the web: moreover the Customer makes every effort not to copy, modify, translate, reproduce, distribute, sell, publish, promote and disseminate in any other way, in a different format, electronically or otherwise, in whole or in part, the information present on the website.
With the inclusion of a wide range of content in studiaetdocumenta.org, the Istituto Storico San Josemaria Escriva does not intend to violate any copyright, industrial property right or any other law. The inclusion of content in studiaetdocumenta.org has been based on the expertise of the Istituto Storico San Josemaria Escriva. The content is authorized by the right holders or is used on the basis of being free or in the public domain; in the event that studiaetdocumenta.org involuntarily includes content that affect the rights of third parties, such third parties may inform the Istituto Storico San Josemaria Escriva who will proceed in accordance with the law.
GRAPHICS, STRUCTURE AND OTHER PROTECTED ELEMENTS IN RELATION TO STUDIAETDOCUMENTA.ORG
The graphics, structure and any other element of studiaetdocumenta.org are protected by the rules governing trade and competition. These cannot be copied, imitated or used, in whole or in part without the prior written permission of the Istituto Storico San Josemaria Escriva. The framing and mirroring of the pages studiaetdocumenta.org is prohibited. Nevertheless, users are allowed to freely provide direct links to pages and items present in studiaetdocumenta.org
APPLICABLE LAW AND JURISDICTION
Notwithstanding the mandatory provisions of the law, the purchase order, the related sales contract and any ensuing right or obligation are subject to Italian law and any dispute regarding these actions will be submitted to the exclusive jurisdiction of the Court of Rome (Italy).
